Your EB-3 Journey

The EB-3 Unskilled Visa Program is a U.S. employment-based immigration pathway that allows eligible foreign nationals to obtain permanent, full-time employment with approved American employers. Through this program, qualified applicants may have the opportunity to live and work in the United States as lawful permanent residents while supporting industries experiencing ongoing workforce shortages.

Wage Assessment & Approval (WAA)

The Wage Assessment & Approval (WAA) is an important stage of the U.S. EB-3 Unskilled Visa Program. During this step, the U.S. Department of Labor determines the standard wage for the offered position based on the job title, responsibilities, and work location. This ensures the salary offered meets or exceeds the prevailing wage for similar positions, protecting fair labor standards for both U.S. employees and foreign workers while maintaining compliance with U.S. immigration and employment regulations.

Securing Employer Approval (SEA)

Once the Wage Assessment & Approval (WAA is completed, the process moves to the Labor Certification (PERM) stage. During this phase, the U.S. employer submits an application to the Department of Labor to confirm that all employment requirements have been met. Processing times may vary depending on the case, and some applications may require additional review or an audit. Successfully completing this step moves your EB-3 application one step closer to the immigration petition stage.

Employer Immigration Petition

After the Securing Employer Approval is approved, the next step is submitting the Form I-140, Immigrant Petition for Alien Worker, to U.S. Citizenship and Immigration Services (USCIS). This petition confirms the employer’s intent to sponsor the qualified applicant for permanent employment in the United States. Applicants may also choose Premium Processing, where available, for an additional government fee to receive a faster decision from USCIS. Approval of the I-140 petition is a significant milestone in the EB-3 immigration process.

Visa Processing & Permanent Residency

After the Form I-140 petition is approved, applicants outside the United States continue through consular processing by submitting Form DS-260. The National Visa Center (NVC) reviews the case before forwarding it to the appropriate U.S. Embassy or Consulate for a visa interview. If approved, the applicant receives an immigrant visa and can travel to the United States, where the Permanent Resident Card (Green Card) is mailed to the registered U.S. address.

Applicants who are already in the United States under an eligible non-immigrant status may apply for Adjustment of Status (Form I-485), along with employment authorization and travel documents, if eligible. This allows qualified applicants to complete the permanent residency process without leaving the United States.

Begin Your New Life in the United States

Upon arrival in the United States, applicants should promptly begin their permanent, full-time employment with the sponsoring employer. This marks the successful completion of the EB-3 journey and the start of a rewarding future as a U.S. permanent resident.

Bring Your Family with You

If your Form I-140 petition is approved, your eligible family members may also qualify to immigrate with you. Your spouse and unmarried children under 21 years of age may apply for the appropriate dependent immigrant visas, allowing your family to live together and begin a new chapter in the United States as lawful permanent residents.
